TripValory.com serves as a platsform to help users arrange bookings with independent tour providers. TripValory.com does not own, manage, or directly offer tours. Your contract is with the tour provider, who is responsible for fulfilling the booking terms.

2. Booking
TripValory.com allows users to book:
- Free Tours: Provided by independent tour providers on a pay-what-you-wish basis; no upfront payment is required.
By placing a booking, you agree to the provider's policies, including any no-show and cancellation rules. Please note that a confirmed booking indicates your interest in a tour. However, the tour provider reserves the right to reject bookings due to full capacity or unforeseen circumstances.

Cancellation Policy
- User cancellations: Users may cancel a booking at any time. While no upfront payment is required for free tours, repeated no-shows may negatively affect your user rating and future booking ability on the platform.
- Provider cancellations: If a tour provider cancels a confirmed booking, the user will be notified by email as soon as possible. TripValory is not liable for losses or inconveniences caused by provider cancellations, though we will make reasonable efforts to assist users in finding alternative options.
- Force majeure: Neither party shall be liable for cancellations resulting from circumstances beyond their reasonable control, including but not limited to natural disasters, government restrictions, or public health emergencies.
3. Registration
To create an account, you will need to provide:
- Personal details: Email, full name, and city of residence
- Reservation details: Number of participants and a contact number
After booking, you will receive a confirmation email with tour details. By completing a booking, you agree to comply with these terms and conditions.
4. Payments and Currency
Payments made through TripValory.com are processed in Euros (EUR) or U.S. Dollars (USD). The final amount may vary slightly due to bank fees and currency conversion rates. TripValory.com is not responsible for any additional fees related to these factors.
The platform allows users to view prices in multiple currencies, with real-time conversions powered by a trusted external service. These conversions are purely for reference, as the final payment at checkout will always occur in Euros or USD. Regardless of the currency displayed during browsing or booking, the customer's credit card will be charged in Euros or USD, and both the receipt and email confirmation will reflect the total in that currency.
By providing your payment information, you confirm that it is accurate and authorized for use. After finalizing your reservation, you will receive a confirmation email.
Refunds: As TripValory.com facilitates free, pay-what-you-wish tours, no upfront payment is typically collected by TripValory. Any tips or payments made directly to tour providers are governed by the provider's own refund policy, for which TripValory bears no responsibility. In cases where a payment is processed through the TripValory platform and a refund is warranted, please contact support@tripvalory.com. within 14 days of the transaction. Refund requests will be reviewed on a case-by-case basis.
5. User and Tour Provider Obligations

User Conduct: Unauthorized or illegal use of the
platform is prohibited. This includes:
- Disruptive actions or harm to the Platform.
- Uploading or sharing malicious software.
- Misrepresentation, unauthorized access, and security violations. TripValory reserves the right to block or remove users violating these terms and may pursue legal actions.

Tour Provider Responsibilities: Providers agree to:
- Tour providers are responsible for organizing tours or routes, ensuring the safety and well-being of all participants, and managing the acceptance, refusal, or removal of any participant whose behavior may disrupt the experience for others.
- As a tour provider, you assure TripValory that you are informed of all obligations related to your activities. This includes, but is not limited to: following designated routes, respecting local regulations where the tour is conducted, and meeting any legal, tax, or fiscal requirements. Additionally, you are responsible for maintaining all necessary licenses or certifications as mandated by local, regional, or national tourism laws. If you represent a company or agency, you are also accountable for ensuring that your employees or associates meet these obligations.
- If you fail to uphold these responsibilities or provide false or misleading information, and TripValory faces any fines, penalties, or claims from government bodies, public agencies, or other entities, you agree to compensate our platform fully for these costs. This includes, but is not limited to, the reimbursement of any penalties and legal or administrative expenses.
- The provider agrees to maintain all necessary licenses, permits, and certifications required to conduct their tours or services where applicable. This includes ensuring that all guides, whether licensed or non-licensed, are properly identified and meet relevant standards for the services they offer.
- If TripValory incurs any fines, penalties, or legal liabilities due to false, misleading, or inaccurate information provided by the provider whether related to licensing, certification, or the use of non-licensed guides the provider agrees to indemnify and cover all associated costs or damages.
- Guides are solely responsible for complying with applicable local, regional, or national laws regarding tour guiding and licensing requirements. TripValory does not guarantee that guides hold the necessary qualifications or licenses to conduct tours safely within specific jurisdictions. It is the responsibility of each guide to determine and obtain any necessary permissions, and the responsibility of users to verify these qualifications if applicable.
6. Waiver of Liability
TripValory acts solely as an intermediary marketplace and does not provide tour guiding services directly. To the fullest extent permitted by applicable law, TripValory disclaims all liability for any loss, damage, injury, or death incurred in connection with services provided by guides listed on the platform, including non-licensed guides. Users acknowledge that engaging with guides particularly those without formal licensing or professional certification carries inherent risks. By booking a tour through TripValory, you voluntarily assume such risks. Nothing in these Terms limits or excludes TripValory's liability for: (a) death or personal injury caused by our own negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be limited or excluded under applicable law, including consumer protection rights under EU law. In jurisdictions where limitation of liability clauses are restricted or prohibited, TripValory's liability shall be limited to the maximum extent permitted by local law.
7. Independent Contractor Status
Guides on TripValory.com, including non-licensed guides, are independent contractors, not employees, agents, or representatives of TripValory. TripValory serves as a marketplace connecting users with independent guides and does not oversee, manage, or control the activities of these guides. By using this platform, you acknowledge and agree that any guiding services are provided independently of TripValory, which does not assume responsibility for the actions, quality, legality, or qualifications of guides.
8. Intellectual Property Rights
TripValory does not claim ownership of user-uploaded content but reserves the right to use it for advertising, publishing, and promotional purposes. Users confirm that all uploaded content (images, text) is original, truthful, and compliant with third-party rights.
9. User-Generated Content
If you submit comments, reviews, or suggestions, you grant TripValory a non-exclusive, royalty-free, worldwide license to use and display your content. All submissions must be lawful, not infringe on third-party rights, and not be harmful or offensive. We reserve the right to remove user-generated content at our discretion.
10. Indemnification
Users and guides agree to indemnify, defend, and hold harmless TripValory, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, losses, damages, costs, or expenses arising from or relating to the services provided by guides, the use of this website, or violations of applicable laws.
Additional Disclosure for Users
Non-Licensed Guides: Some tours offered on TripValory.com are provided by guides who may not hold official tour guiding licenses. This information is disclosed to help users make informed choices. Users are responsible for evaluating whether a guide's background meets their needs and for confirming guide qualifications if required.
11. Insurance Disclaimer
TripValory encourages all guides to obtain liability insurance. However, TripValory does not provide or verify the existence of such insurance for guides. Users are encouraged to exercise caution and assume personal responsibility when engaging with non-licensed or amateur guides.
12. Termination
TripValory may terminate or suspend your access without notice for violations of these Terms or harmful conduct toward other users. You may discontinue your use of the Website at any time.
13. Governing Law and Dispute Resolution
These Terms and Conditions are governed by and construed in accordance with the laws of the Kingdom of Morocco, including but not limited to:
- Law No. 31-08 on Consumer Protection measures
- Law No. 53-05 on the Electronic Exchange of Legal Data
- Law No. 09-08 on the Protection of Personal Data
Negotiation First: In the event of any dispute, controversy, or claim arising out of or relating to these Terms, the parties agree to first attempt resolution through good-faith negotiation by contacting us at support@tripvalory.com. We will endeavor to respond and resolve the matter within 30 days. Mediation: If the dispute cannot be resolved through negotiation, either party may refer the matter to mediation before a recognized mediation center in Morocco, in accordance with Law No. 08-05 on Arbitration and Conventional Mediation. Jurisdiction: If mediation fails or is not pursued, both parties irrevocably submit to the exclusive jurisdiction of the competent courts of Casablanca, Morocco (or the court of the city where TripValory's registered office is located), for the resolution of any disputes arising out of or in connection with these Terms. For EU-Based Users: While these Terms are governed by Moroccan law, users residing in the European Union retain the benefit of any mandatory consumer protection provisions under the laws of their country of residence, to the extent that such provisions cannot be contractually waived. EU consumers may also access the EU Online Dispute Resolution platform at: https://ec.europa.eu/consumers/odr. Language: In the event of any conflict between a translated version of these Terms and the English version, the English version shall prevail.
14. Changes to Terms
TripValory reserves the right to modify these Terms at any time. Changes are effective immediately upon posting on the Website. Your continued use of the Website constitutes acceptance of the revised Terms.
